NSCDC Ordered by Court to Pay Niger Lawyer N5 Million in Damages for Human Rights Violation

An order has been issued by the Minna High Court 4 in Niger State, directing the Nigeria Security and Civil Defence Corps, NSCDC, to compensate a Minna-based legal practitioner, Mr. Ifeanyichukwu Emmanuel Igwe, with N5 million in damages.

The presiding Judge, Justice Mohammed Mohammed, also mandated a payment of N200,000 as the cost incurred during the legal proceedings, along with a five percent monthly interest on the awarded sum.

In his legal case numbered NSHC/MN/112/2023, Igwe, represented by Bar Bala Ibrahim Zuru, took the matter to the High Court, alleging the infringement of his fundamental human rights within the state.

The respondents named in the case are the Commandant-General of the NSCDC, CG Abubakar Abdullahi Audi; the NSCDC headquarters, the State Commandant of the Corps, Namadi Nura, and Mr. Henry Bawa.

Justice Mohammed emphasized that the applicant has the right to human dignity guaranteed under Section 34 (1) of the Constitution of the Federal Republic,1999.

He stated that the conduct of the first and second defendants, as well as other representatives of the third and fourth defendants, who reportedly assaulted and abused the complainant using sticks and fists at the fourth defendant’s office along David Mark Road in Minna, constitutes a violation of his human rights.

He further stated, “The awarded sum of N 5,000,000.00 is to be paid as damages jointly and severally by the respondents in favor of the applicant as compensation for the breach of his fundamental rights”.
