Lawyer, Ejimakor: Preparing Kanu’s defense against death penalty charges proving difficult

Alloy Ejimakor, the Lead Counsel for Nnamdi Kanu, the leader of the Indigenous People of Biafra, IPOB, has highlighted a significant challenge in properly preparing the agitator’s defense against charges carrying the death penalty.

He mentioned that he and his legal team have not been given adequate access to consult with Kanu to effectively prepare a defense against the serious charges.

Speaking to reporters in Abuja, the lead counsel expressed frustration over the controlled nature of their discussions with the IPOB leader, hindering their defense preparations.

According to Ejimakor, the restricted access hampers their ability to have confidential discussions with Kanu which are vital in preparing a robust defense against charges that could result in the death penalty.

He emphasized, “Our stance is in accordance with the law. Section 36 of the Nigerian constitution asserts that no Nigerian should face trial unless a fair hearing is guaranteed.”

The IPOB leader is currently facing terrorism charges before the Federal High Court presided over by Justice Binta Nyako.

During the recent court proceedings, Ejimakor emphasized the need for “fair hearing safeguards” for Kanu before the terrorism trial commences.

The trial judge has scheduled May 20 to rule on Kanu’s bail application and his plea to be transferred from the custody of the Department of State Services (DSS) to house arrest.

In a motion presented by Ejimakor, Kanu, who has been in detention since 2021, requested the court to reinstate the bail granted to him in 2017 by the same Judge.

Kanu informed the court that he did not violate his bail conditions or abscond as alleged by the Federal Government but had to flee the country when his residence was reportedly raided by the military.
