Peoples Democratic Party: APC lawmakers are barred from impeaching Fubara, Says PDP


In response to the directive from the state APC chapter for the lawmakers to initiate impeachment procedures against Governor Siminalayi Fubara, the Peoples Democratic Party (PDP) has emphasized that the All Progressives Congress (APC) lawmakers at the Rivers House of Assembly are no longer recognized members of the House.

During a press briefing held in Abuja on Wednesday, the PDP National Publicity Secretary, Debo Ologunagba, expressed that the move by the APC lawmakers to impeach the governor is futile.

Ologunagba highlighted that the lawmakers from the APC have forfeited their positions in the House, based on Section 109 (1) (g) of the 1999 Constitution.

“Those purporting to be APC members in the assembly lost their parliamentary seats following their departure from the PDP, the political platform through which they were elected into office,” he stated.

Regarding Section 109 (1) (g) of the 1999 Constitution, he explained that it mandates that a House of Assembly member must vacate their post if they switch to another political party before the completion of their elected term.

“It is crucial to note that Section 109 (1) (g) of the Constitution is self-enforcing. Consequently, the defection of the Rivers State House of Assembly members led to an automatic voiding of their positions,” he added.
