Court Decision on Ganduje Suspension: IGP Restricted from Engaging with Ward Officers


In a recent ruling at the Kano State High Court, Justice Yusuf Ubale Muhammad has issued an ex parte order preventing the Inspector General of Police (IGP), the Assistant Inspector General (AIG) Zone 1 Kano, and the Commissioner of Police, Kano, from summoning, arresting, or disturbing the All Progressives Congress (APC) ward officers at Ganduje Ward in Dawakin-Tofa local government area.

The decision to suspend the APC’s National Chairman, Abdullahi Ganduje, by the Ganduje Ward officers was later overturned by the state working committee of the party.

Subsequently, ward officers took legal action seeking judicial confirmation of Ganduje’s suspension, which allegedly led to security operatives searching for the ward officers.

Justice Yusuf Ubale Muhammad, in the order granted on May 2, 2024, stated that until the hearing and determination of the motion on notice, the APC National Working Committee (NWC), the Kano State Working Committee, and Ganduje are prohibited from utilizing security personnel to apprehend or detain the ward executives.

Through their legal representative, Shamsu Ubale Jibrin Esq, Jafar Adamu, Haladu Gwanjo, Laminu Sani Barguma, and 10 other factional ward officers filed an ex parte motion seeking protection of their constitutional rights.

Applicant Jafar Adamu, Haladu Gwanjo, and Laminu Sani Barguma swore two affidavits challenging the IGP, AIG Zone 1 Kano, Commissioner of Police Kano, APC, APC NWC, Kano APC State Council, and Ganduje himself.

The court also directed that the interim order for the motion on notice and all other legal proceedings in this case be served promptly on all the respondents before the next adjourned date. The case has been adjourned to June 5, 2024, for the hearing of the motion on notice.
