Legal Battle: Nnamdi Kanu Challenges Trial Jurisdiction with Abuja Court Appeal


Leading the legal team representing Nnamdi Kanu, the leader of the Indigenous People of Biafra, IPOB, Aloy Ejimakor, has taken action by filing a brief with the Appeal Court opposing the ruling made by the Abuja Federal High Court.

Within the brief, Ejimakor has raised objections to the Abuja Federal High Court’s jurisdiction in trying Kanu.

Previously, on the 19th of June 2024, Justice Binta Nyako of the Abuja Federal High Court had dismissed the objections contesting her jurisdiction.

Following Nyako’s decision, Kanu proceeded to the Court of Appeal.

However, in the brief submitted on Friday, Ejimakor stated: “Today, I have submitted a brief to the Court of Appeal raising objections to the jurisdiction of the Federal High Court to prosecute Nnamdi Kanu.

“I have presented six issues for the Court of Appeal to consider, along with various requests, including putting a stop to Kanu’s trial, dropping all charges against him, and securing his release from custody. We anticipate a favorable outcome based on the merits of the argument.

“This document is the Appellant’s Brief of Argument filed following the Notice of Appeal against the ruling of the Federal High Court (Abuja) issued on the 19th of June 2024, which rejected the Appellant’s Preliminary Objection to the trial court’s jurisdiction.

“The ruling being appealed can be found on Pages 413 – 415 of the Record of Appeal, while the Notice of Appeal is located on Pages 416 – 428 of the Record of Appeal. The Notice of Appeal outlines 5 grounds from which the issues being raised have been extracted.

“This case was first initiated around the 14th of October.”
