Abba Kyari’s Bail Application Rejected by Court

The bail application filed by suspended Deputy Commissioner of Police, Abba Kyari, and three others has been denied once again by the Federal High Court Abuja.

Kyari and the three defendants argued in their bail application that new facts related to the Kuje Prison break and alleged threats to their lives justified their new application.

In response, the NDLEA objected, arguing that they have not shown how the new issues would not lead to them jumping bail.

Justice Emeka Nwite, delivering the judgment, agreed with the NDLEA legal team that the defendants had not demonstrated how they would not jump bail and interfere with the administration of criminal justice. The court held that a threat to life in a detention facility is not a factor for granting bail.

The prosecution, in its counter affidavit, claimed that Mr. Kyari and his co-defendants are flight risks and would tamper with the money laundering investigations and the trial’s witnesses.

The court had previously made a ruling on the defendants’ bail and stated that there was nothing presented to warrant a reconsideration.
